How we reward loyalty matters to us. At FamilyMart, we are working hard to serve shoppers a little better every day. Looking after the personal data you share with us is an immensely important part of this. We want you to be confident that your data is safe and secure with us, and understand how we use it to offer you a better and more personalised shopping experience.

This Privacy Policy explains in detail the types of personal data we may collect about you when you interact with us. It also explains how we will store and handle that data, and keep it safe.

This Privacy Policy applies if you interact with us through our stores, over the phone, online, through our mobile applications or otherwise by using our websites or interacting with us on social media (our "Services”).

WHO ARE WE

When we say ‘we’ or ‘us’ in this policy, we are referring to QL Maxincome Sdn Bhd ("QL Maxincome”) the company carrying on the FamilyMart business, QL Maxincome’s related corporations, and affiliates (collectively referred to as the "FamilyMart Group”)

WHAT TYPE OF INFORMATION DO WE COLLECT?

Your personal details in order to process your application for registration of membership with us, use of the loyalty program mobile application and/or use of the E-Commerce platform mobile application. These details may include your name, e-mail address, postal address, credit/debit card and/or bank details and mobile phone number. This list is not exhaustive and may include other relevant personal details. It is important to note that all information requested is obligatory to be provided by you unless we indicate otherwise. Should you fail to provide the obligatory information we may be unable to process your application.
Your account login details such as your mobile number and for security, an encrypted record of your login password.
Details of your interactions with us through in store, online or by using our mobile applications.
- For example, we collect notes from our conversations with you, details of any complaints or comments you make, details of purchases you made, voucher redemptions, and how and when you contact us.
Details of your shopping preferences.
- For example, which of our shops you prefer to visit and where you redeem your vouchers.
Details of your visits to our websites or mobile applications, and which site you came from to ours.
Information gathered by the use of cookies. Learn more about how we use cookies and similar technologies in the Cookies section below.
Personal details which help us to recommend items of interest. We will only ask for and use your personal data collected for recommending items of interest and to tailor your shopping experience with us.
Your comments and product reviews.
Your image may be recorded on CCTV when you visit a shop.
When you contact us or we contact you or you take part in promotions, competitions, surveys or reviews about our Services.
Your social media username, if you interact with us through those channels, to help us respond to your comments, questions or feedback.

HOW AND WHY DO WE USE YOUR PERSONAL DATA?

We want to give you the best possible customer experience. One way to achieve that is to get the richest picture we can of who you are by combining the data we have about you.
We then use this to offer you promotions, products and services that are most likely to interest you. We will also offer you relevant rewards.
The data privacy law allows this as part of our legitimate interest in understanding our customers and providing the highest levels of service. Of course, if you wish to change how we use your data, you’ll find details in the ‘Your Rights?’ section below.
Remember, if you choose not to share your personal data with us, or refuse certain contact permissions, we may be unable to process your application for registration of membership for our loyalty program and/or our E-Commerce Platform.
We may use your information in the following ways:
- Make our Services and Membership rewards benefit (where applicable) - Manage your loyalty program account you hold with us and verify your identify. Including but not limited to providing you with your loyalty program, points, vouchers and/or coupons you earned while being our loyal customer.
- To personalise your shopping experience - we try to understand our customers so we can provide you with a great shopping experience, relevant marketing, personalised offers, shopping ideas and online advertising. Understanding how you use our mobile applications, how you interact with us, where you shop, the products and services you buy and how you use and browse our websites helps us to do this.
- For safety and security - we use your personal information to help provide safe and secure environments for our colleagues to work in, our customers to shop in and for our businesses to be conducted. To enable this we use CCTV, monitor online behaviour and carry out checks to help us ensure that our customers are genuine to prevent fraud and to help customers use our services appropriately.
- Analytics and profiling - we use your personal information for statistical analysis and to help us understand more about our customers. That includes understanding the products and services you buy and the manner in which you consume them. This helps us to serve you better and to find ways to improve our services, stores, mobile applications and websites. These profiles help us to send you offers that are more relevant to you.
- Contacting you - we use your personal information to contact you: either to conduct market research or to contact you about products and services from us and other companies. We may also contact you in relation to any questions and/or feedback you have raised with us directly, through our feedback form or through the Help Centre and/or to discuss the status of your account with us.
- Processing payments – we use your personal information to enable our payment processing and refund function

WHO MIGHT WE SHARE YOUR PERSONAL DATA WITH?

The FamilyMart Group - we will share your personal information in certain circumstances with the other companies within the FamilyMart Group so that we can provide you with a high quality, personalised and tailored service (including relevant marketing) across our FamilyMart Group.
Our authorised service providers - we work with partners, suppliers, insurers, aggregators and agencies so that they can help us provide the products and services you require from us. These third parties process your personal information on our behalf and are required to meet our high standards of security before doing so. We only share information that allows them to provide their services to us or to facilitate them providing their services to you. These third parties include:
- Our delivery services providers (including its delivery agents / riders), who help us deliver our products to you;
- Advertising companies, who help us place FamilyMart’s Group adverts online;
- Market research partners, who help us to analyse customer behaviour;
- Social media providers – such as Facebook, Instagram and Twitter – where we interact with you on social media;
- Third party vendors who help us to manage and maintain the Group IT infrastructure;
- Providers of temporary staff, who need access to certain personal information to carry out their role within the business;
- Where relevant, our professional advisors, such as lawyers and consultants;
- Companies that provide insights and analytics services for us so we can stock the right products, send the right marketing campaigns and understand our business and customers better;
- Security and fraud prevention companies to ensure the safety and security of our customers, colleagues and business;
- Companies who assess faults and repair products on our behalf;
- Companies administer competitions for us so they run smoothly; and
- Companies that enable us to collect your reviews and comments, both online and offline.
Other organisations and individuals - we may share your personal information in certain scenarios.
- If we're discussing selling or transferring part or all of a FamilyMart’s Group business, we may share information about you to prospective purchasers and their advisers - but only so they can evaluate the relevant business; or
- If we are reorganised or sold to another organisation, we may transfer information we hold about you to them so they can continue to provide our Services to you.
- If we are required to by law, under any code of practice by which we are bound or where we are asked to do so by a public or regulatory authority such as the police.
- If we need to do so in order to exercise or protect our legal rights, users, systems and services; or
- In response to requests from individuals (or their representatives) seeking to protect their rights or the rights of others. We will only share your personal information in response to requests which do not override your privacy interests. For example, we will not share your personal information with individuals who are merely curious about you, but we will share your personal information to e.g. insurers, solicitors, employers etc. which have a legitimate interest in your personal information.
Further, please be informed that if required for any of the foregoing Purposes, your Personal Data may be transferred to locations outside Malaysia.

MARKETING & ADVERTISING CAMPAIGNS

This section explains our advertising approach and the choices you have when it comes to receiving marketing communications.
- We allow advertisers to run ad campaigns on our Services.
- The information and advertisements that you see when accessing our Services may be targeted on the basis of your current activity or contextual information based on your current purchases.
- In our mobile applications, you can manage your preference and opt out from one or all of the different push notifications by selecting or deselecting the relevant options in the Settings Section of your device.

- It is clarified that we are not responsible for the content of said advertisements and the products delivered or services rendered thereby by third parties and you irrevocably and unconditionally agree that we shall not be held responsible or liable for any loss, damage, cost or expense that you may suffer or incur as a result or in connection thereof.

Cookies are small text files which are placed on your device via your browser when you visit the website. Some cookies that we use may collect personal data about you. In our privacy policy, we explain what "personal data" is, what personal data we collect about you and how we use it.

GOOGLE ANALYTICS

We use the web analytics services Google Analytics. These services use cookies to collect information such as your IP address or other identifiers, browser information, and the content you view for the purpose of analysing how visitors use our app and/or website and for us to gain customer insight and to improve the way our site works. The information generated by the cookies about your use of the app and/or website will be transmitted to and stored by these service providers on servers that may be outside Malaysia. These service providers will use this information on our behalf for the purpose of evaluating the number of users on our app and/or website, the location of our users, the most frequently used parts of our app and/or website, the most commonly used browsers to enhance functionality, and the interests of our users.
Please note that the IP address that your browser conveys within the scope of Google Analytics will not be associated with any other data held by Google and Google Analytics does not collect any personal information.

HOW WE PROTECT YOUR PERSONAL DATA

We know how much data security matters to all our customers. With this in mind we will treat your data with the utmost care and take all appropriate steps to protect it.
We secure access to all transactional areas of our websites and apps using ‘https’ technology.
Access to your personal data is password-protected.
We regularly monitor our system for possible vulnerabilities and attacks, and we carry out penetration testing to identify ways to further strengthen security.

HOW LONG WILL WE KEEP YOUR PERSONAL DATA?

Whenever we collect or process your personal data, we will only keep it for as long as is necessary for the purpose for which it was collected. At the end of that retention period, your data will either be deleted completely or anonymised, for example by aggregation with other data so that it can be used in a non-identifiable way for statistical analysis and business planning. In most cases, our retention period will come to an end 7 years after the end of your relationship with us.

Our website and app may contain links to other websites and social media sites operated by third parties. Please note that we have no control over how those third parties collect and use your personal data. Those third-party sites may have their own privacy policies. You have a number of rights under data protection legislation which, in certain circumstances, you may be able to exercise in relation to the personal information we process about you

SIAPA KAMI

Apabila kami merujuk kepada ‘kami’ atau ‘kita’ dalam dasar ini, kami merujuk kepada QL Maxincome Sdn Bhd (“QL Maxincome”), syarikat yang menjalankan perniagaan FamilyMart, syarikat berkaitan dengan Maxincome dan syarikat-syarikat bersekutu (secara kolektif dirujuk sebagai “Kumpulan FamilyMart”).

APAKAH JENIS MAKLUMAT YANG KAMI MENGUMPUL?

Data peribadi anda untuk memproses permohonan anda bagi tujuan pendaftaran keahlian dengan kami, penggunaan aplikasi telefon mudah alih program kesetiaan dan/atau penggunaan aplikasi telefon mudah alih E-Dagang. Butiran ini mungkin termasuk nama, alamat e-mel, alamat pos, butiran kad kredit/debit dan/atau butiran perbankan dan nombor telefon bimbit anda. Senarai ini tidak menyeluruh dan mungkin termasuk data peribadi lain yang berkaitan. Ia adalah penting untuk mengambil perhatian bahawa semua maklumat yang diminta adalah wajib diberikan oleh anda selain kami menyatakan sebaliknya. Data peribadi yang membantu kami mencadangkann barangan yang menarik perhatian anda. Kami hanya akan meminta dan menggunakan data peribadi anda yang dikumpul untuk mencadangkan barangan yang menarik dan untuk penyesuaian pengalaman membeli-belah anda dengan kami.
Komen dan ulasan anda mengenai produk.
Imej anda mungkin direkodkan di CCTV apabila anda melawat kedai kami.
Apabila anda menghubungi kami atau kami menghubungi anda ataupun apabila anda mengambil bahagian dalam promosi, pertandingan, tinjauan atau ulasan mengenai Perkhidmatan kami.
Nama pengguna media sosial anda, jika anda berinteraksi dengan kami melalui saluran tersebut, untuk membantu kami menjawab komen, soalan atau maklum balas anda.

BAGAIMANA DAN MENGAPA KAMI MENGGUNAKAN DATA PERIBADA ANDA?

Kami ingin memberikan anda pengalaman pelanggan yang terbaik. Salah satu cara untuk mencapai objektif ini adalah dengan menggabungkan data yang kami mempunyai mengenai anda.

- Memberi Perkhidmatan dan faedah ganjaran Keahlian kami (di mana berkenaan) kepada anda – Mengurus akaun program kesetiaan anda yang anda memegang dengan kami dan mengesah identiti anda. Termasuk tetapi tidak terhad kepada melengkapkan anda dengan program kesetiaan, mata, baucar dan/atau kupon yang anda memperolehi semasa anda menjadi pelanggan setia kami.
- Untuk memperibadikan pengalaman membeli-belah anda – kami cuba memahami pelanggan kami supaya kami boleh memberikan anda pengalaman membeli-belah yang baik, pemasaran yang berkaitan, tawaran yang diperibadikan, idea membeli-belah dan pengiklanan dalam talian. Memahami bagaimana anda menggunakan aplikasi telefon mudah alih kami, bagaimana anda berinteraksi dengan kami, di mana anda membeli-belah, produk dan perkhidmatan yang anda membeli dan bagaimana anda menggunakan dan melayari laman web kami membantu kami melakukan ini.
- Untuk keselamatan – kami menggunakan data peribadi anda untuk membantu menyediakan persekitaran yang selamat dan terjamin untuk rakan sekerja kami, pelanggan kami untuk membeli-belah dan untuk menjalankan perniagaan kami. Untuk melakukan ini, kami menggunakan CCTV, pemantauan tingkah laku atas talian dan melaksanakan pemeriksaan untuk membantu kami memastikan bahawa pelanggan kami adalah sahih, untuk mencegah penipuan dan untuk membantu pelanggan menggunakan perkhidmatan kami dengan sewajarnya.
- Analitis dan pemprofilan – kami menggunakan data peribadi anda untuk analisis statistik dan untuk membantu kami lebih memahami pelanggan kami. Ini termasuk memahami produk dan perkhidmatan kami yang anda membeli dan cara anda menggunakannya. Ini membantu kami memberi perkhidmatan yang lebih baik kepada anda dan untuk mencari cara-cara untuk menambah baik perkhidmatan, kedai, aplikasi telefon mudah alih dan laman web kami. Profil tersebut membantu kami untuk menghantar kepada anda tawaran yang lebih berkaitan dengan anda.
- Menghubungi anda – kami menggunakan data peribadi anda untuk menghubungi anda: sama ada untuk menjalankan penyelidikan pemasaran atau untuk menghubungi anda mengenai produk dan perkhidmatan daripada kami dan syarikat lain. Kami juga mungkin menghubungi anda berhubungan dengan mana-mana soalan dan/atau maklum balas yang anda mengemukakan secara langsung atau melalui borang maklum balas kami atau melalui Pusat Bantuan atau untuk membincangkan status akaun anda dengan kami.
- Memproses pembayaran – kami menggunkan data peribadi anda untuk menjalankan proses pembayaran dan fungsi pembayaran-balik.

SIAPAKAH YANG KAMI MUNGKIN BERKONGSI DATA PERIBADI ANDA DENGAN?

Kumpulan FamilyMart – kami akan berkongsi data peribadi anda dalam keadaan tertentu dengan syarikat lain dalam Kumpulan FamilyMart supaya kami boleh menyediakan anda dengan perkhidmatan yang berkualiti tinggi, diperibadikan dan disesuaikan (termasuk pemasaran yang berkaitan) merentasi Kumpulan FamilyMart kami.
Pembekal perkhidmatan kami yang diberi kuasa – kami bekerja dengan rakan kongsi, pembekal, penanggung insurans, pengagregat dan agensi supaya mereka boleh membantu kami menyediakan produk dan perkhidmatan yang anda perlukan daripada kami. Pihak ketiga tersebut memproses data peribadi anda bagi pihak kami dan adalah dikehendaki memenuhi tahap keselamatan kami yang tinggi sebelum berbuat demikian. Kami hanya berkongsi maklumat yang membolehkan mereka menyediakan perkhidmatan mereka kepada kami atau untuk membantu mereka untuk menyediakan perkhidmatan mereka kepada anda. Pihak ketiga tersebut termasuk:
- Pembekal perkhidmatan penghantaran kami (termasuk agen penghantaran / penunggang mereka), yang membantu kami menghantar produk kami kepada anda;
- Syarikat pengiklanan, yang membantu kami memaparkan iklan Kumpulan FamilyMart secara dalam talian;

- Pembekal media sosial – seperti Facebook, Instagram dan Twitter – di mana kami berinteraksi dengan anda di media sosial;
- Vendor pihak ketiga yang membantu kami menguruskan dan mengekalkan infrastruktur IT Kumpulan;
- Pembekal kakitangan sementara, yang memerlukan akses kepada data peribadi tertentu untuk menjalankan peranan mereka dalam perniagaan;
- Di mana berkaitan, penasihat profesional kami, seperti peguam dan perunding;
- Syarikat yang menyediakan pandangan dan perkhidmatan analitis untuk kami supaya kami boleh stok produk yang betul, menghantar kempen pemasaran yang betul serta memahami perniagaan dan pelanggan kami lebih baik;
- Syarikat keselamatan dan pencegahan penipuan untuk memastikan keselamatan dan keterjaminan pelanggan, rakan sekerja dan perniagaan kami;
- Syarikat yang menilai kesilapan dan membaiki produk bagi pihak kami;
- Syarikat yang mentadbir pertandingan-pertandingan untuk kami supaya mereka berjalan dengan lancar; dan
- Syarikat yang membolehkan kami mengumpul ulasan dan komen anda dari dalam talian dan luar talian.
Organisasi dan individu lain – kami mungkin berkongsi data peribadi anda dalam keadaan tertentu.
- Jika kami berbincang untuk menjual atau memindahkan sebahagian atau semua perniagaan Kumpulan FamilyMart, kami mungkin berkongsi maklumat anda kepada bakal pembeli dan penasihat mereka (atas asas perlu tahu sahaja)– tetapi hanya supaya mereka boleh menilai perniagaan yang berkaitan; atau
- Jika kami disusun semula atau dijual kepada organisasi yang lain, kami mungkin memindahkan maklumat yang kami pegang mengenai anda kepada mereka supaya mereka boleh meneruskan memberi Perkhidmatan kami kepada anda.
- Jika kami dikehendaki oleh undang-undang, di bawah mana-mana tataamalan yang kami terikat atau di mana kami diminta untuk berbuat demikian oleh pihak berkuasa awam atau pihak berkuasa seperti polis.
- Jika kami perlu berbuat demikian untuk melaksanakan atau melindungi hak undang-undang, pengguna, sistem dan perkhidmatan kami; atau
- Sebagai tindak balas terhadap permintaan daripada individu (atau wakil mereka) yang ingin melindungi hak mereka atau hak pihak lain. Kami hanya akan berkongsi data peribadi anda sebagai tindak balas terhadap permintaan yang tidak mengatasi kepentingan privasi anda. Sebagai contoh, kami tidak akan berkongsi data peribadi anda dengan individu yang hanya ingin tahu tentang anda, tetapi kami akan berkongsi data peribadi anda kepada c.t.h. penanggung insurans, peguamcara, majikan dan lain-lain yang mempunyai kepentingan sah(‘legitimate interest’) dalam data peribadi anda.
Selanjutnya, sila dimaklumkan bahawa jika dikehendaki untuk mana-mana Tujuan di atas, Data Peribadi anda mungkin akan dipindahkan ke lokasi di luar Malaysia.

PEMASARAN DAN KEMPEN PENGIKLANAN

Bahagian ini menerangkan pendekatan pengiklanan kami dan pilihan yang anda ada apabila anda menerima komunikasi pemasaran.
- Kami membenarkan pengiklan untuk menyiarkan kempen iklan pada Perkhidmatan kami.
- Maklumat dan iklan yang anda lihat semasa mengakses Perkhidmatan kami mungkin disasarkan berdasarkan aktiviti semasa anda atau maklumat kontekstual berdasarkan pembelian semasa anda.

KUKI

Kami mengguna perkhidmatan analitis web Analitis Google. Perkhidmatan ini menggunakan kuki untuk mengumpul maklumat seperti alamat IP anda atau pengenal pasti lain, maklumat pelayar dan kandungan yang anda lihat untuk tujuan menganalisis cara pelawat menggunakan aplikasi dan/atau laman web kami dan untuk kami mendapatkan pandangan pelanggan dan untuk menambah baik cara laman kami berfungsi. Maklumat yang dijana oleh kuki mengenai penggunaan aplikasi anda dan/atau laman web akan dihantar dan disimpan oleh pembekal perkhidmatan tersebut dalam pelayan yang mungkin berada di luar Malaysia. Pembekal perkhidmatan tersebut akan menggunakan maklumat ini bagi pihak kami untuk tujuan menilai bilangan pengguna bagi aplikasi dan/atau laman web kami, lokasi pengguna kami, bahagian yang paling kerap diguna bagi aplikasi dan/atau laman web kami, pelayar yang paling biasa digunakan untuk meningkatkan fungsi dan minat pengguna kami.
Sila ambil perhatian bahawa alamat IP yang disampaikan oleh pelayar anda dalam skop Analitis Google tidak akan dikaitkan dengan sebarang data lain yang disimpan oleh Google dan Analitis Google tidak mengumpul sebarang data peribadi.

Kami menjamin akses kepada semua bahagian transaksi di laman web dan aplikasi kami menggunakan teknologi ‘https’.
Akses kepada data peribadi anda adalah dilindungi kata laluan.
Kami sering memantau sistem kami untuk kelemahan dan serangan yang mungkin ada dan kami menjalankan ujian penembusan untuk mengenal pasti cara untuk mengukuhkan lagi keselamatan.

BERAPA LAMA KAMI AKAN MENYIMPAN DATA PERIBADI ANDA?

Bila-bila masa kami mengumpul atau memproses data peribadi anda, kami hanya akan menyimpannya selagi diperlukan untuk tujuan yang mana ia dikumpulkan. Pada akhir tempoh penyimpanan itu, data anda sama ada akan dipadamkan sepenuhnya atau dijadikan bentuk yang mana anda tidak boleh dikenal pasti, sebagai contoh secara pengagregatan dengan data lain supaya ia boleh digunakan dalam cara yang tidak boleh dikenal pasti untuk analisis statistik dan perancangan perniagaan. Dalam kebanyakan kes, tempoh penyimpanan kami akan berakhir 7 tahun selepas pengakhiran hubungan anda dengan kami.

LAMAN PIHAK KETIGA

FAMILYMART’S LOYALTY PROGRAMME TERMS & CONDITIONS

GENERAL

The FamilyMart Loyalty Programme ("Loyalty Programme”) is operated through the mobile application (and its associated software) supplied by QL Maxincome Sdn. Bhd. ("FamilyMart”, and such mobile application, the "Mobile App”) and governed by the following terms and conditions and any other policies, FAQs, guidelines pertaining to the Loyalty Programme as may be in place from time to time ("Terms and Conditions”).
Please read these Terms and Conditions carefully. By successfully signing up as a member to the Loyalty Programme through the Mobile App ("Member”) and using the Mobile App, you are deemed to have read, understood, accepted and agree to be bound by each term and condition as contained in these Terms and Conditions. The Terms and Conditions stated herein constitute a legal agreement between you and FamilyMart.
FamilyMart reserves the right to, at its sole and absolute discretion from time to time without prior notification, amend, modify, update, change and / or terminate the Loyalty Programme and / or all or any portion of the Terms and Conditions ("Amendments”, and "Amended” shall be construed accordingly); and any Amendments will be effective immediately upon posting of the same on the FamilyMart website at familymart.com.my ("Website”) and / or the Mobile App. Each Amended version of the Terms and Conditions shall apply and supersede all previous versions including the hardcopy version (if any). In the event of any inconsistency between these Terms and Conditions and any other material in any medium containing information on the Loyalty Programme, these Terms and Conditions (as Amended) shall prevail.
By signing up, you agree that it is your responsibility as a Member to keep yourself updated with the Terms and Conditions (as Amended). Any continued participation as a Member or use of the Mobile App after any Amendments to the Terms and Conditions shall constitute consent, acceptance and affirmative agreement by the Member to the Terms and Conditions as they exist from time to time, including, without limitation, the Amended Terms and Conditions. FamilyMart shall not be held liable for any loss, damage or expense accrued (regardless of whether FamilyMart receives prior notice or advice of the possibility of damage) as a result from any Amendments to the Loyalty Programme or these Terms and Conditions.
If you do not agree to or fall within the Terms and Conditions and wish to discontinue using the Loyalty Programme, please do not continue using the Mobile App or the Loyalty Programme and proceed with termination as set out in Paragraph 2.10 of this Terms and Conditions.

MEMBERSHIP

Membership to the Loyalty Programme is opened to all individuals aged eighteen (18) years old and above residing in Malaysia and Singapore, subject to the following ("Membership”):
- The Membership is not available to individuals under the age of eighteen (18) years old.
- The Membership is not available to individuals that are not allowed for any reason whatsoever to enter into a contractual relationship.
- Corporations, partnerships, limited liability companies, trusts, organisations, societies or any other legal entities are not permitted to apply or sign-up for the Membership.
- Employees of FamilyMart, its parent company, subsidiaries, affiliates and related companies are not permitted to apply or sign-up for the Membership.
To sign-up for the Membership vide the Mobile App, no membership fee will be imposed. However, application of the Membership must be accompanied by completion of details marked as mandatory fields in the sign-up page on the Mobile App. You shall ensure the details provided are true, accurate, current and complete. Points accumulation will only start after Membership application is complete and successful.
Each individual shall only be entitled to apply for ONE (1) Membership.
- Multiple applications by an individual are not allowed. If a Member inadvertently creates one or more duplicate account(s), FamilyMart reserves the right to either merge and consolidate the details and points earned on the duplicate account(s) of the Member into the Member's earlier account, retaining their original expiry date or forfeit such points earned on the duplicate account(s), and thereafter cancel all duplicate account(s).
- FamilyMart shall not be responsible for any loss of Rewards (as hereinafter defined) earned, Membership privileges and / or services due to duplicate account(s) of a Member, regardless of whether such Member has knowledge of the duplicate account(s).
The Membership is non-transferable, non-assignable and is for the exclusive use of Members.
Membership shall be valid and used in any FamilyMart outlet within Malaysia only.
FamilyMart reserves the right to verify the eligibility of any individual who signed-up and may refuse the Membership application of any individual that provides inaccurate, incomplete details or it determines to be tampering with the Membership sign-up process including but not limited to providing inaccurate, incomplete or false details.
By utilising the Membership, you expressly represent and warrant that you are legally entitled to accept and agree to the Terms and Conditions and that you are at least eighteen (18) years old. By utilising the Membership, you further represent and warrant that you have the right, authority and capacity to utilise the Membership and to abide by the Terms and Conditions. Your use of the Membership is for your own sole, personal use. You further confirm that all the information provided by you shall be true and accurate. You undertake not to authorise others to use your identity or user status, and you may not assign or otherwise transfer your Membership account to any other person or entity. When using the Membership, you agree to comply with all applicable laws.
At any time where there is reasonable suspicion of any abuse and / or misuse of the Membership or any unethical behaviour in relation to FamilyMart, including but not limited to stealing, abusive or offensive behaviour, using the Mobile App for the purpose for which it is not intended to be used, acting in breach or potential breach of these Terms and Conditions and / or prolonged period of inactivity as deemed unsuitable by FamilyMart, FamilyMart reserves the right to suspend and / or terminate the Membership immediately and forfeit all Membership rewards, including but not limited to points accumulated, discounts, rebates, gifts, products, vouchers, coupons and / or any other benefits or privileges ("Rewards”) earned without prior notification. For the avoidance of doubt, the termination of the Membership shall not require FamilyMart to compensate, reimburse or cover any cost or losses incurred by you in the course of you being a Member. No correspondence will be entertained.
It is your responsibility to check and ensure that you have downloaded the latest version of the Mobile App for your device. FamilyMart is not liable if you do not have a compatible mobile or electronic device or you have downloaded an outdated or defunct version of the Mobile App to your mobile or electronic device. FamilyMart does not guarantee that the Mobile App will function and remain compatible at all times on any particular mobile or electronic device.
Members shall have a right to terminate the Membership at any time either by sending an email to FamilyMart at members-familymart@ql.com.my or in the event of a prolonged period of inactivity as deemed unsuitable by FamilyMart, FamilyMart shall deem the Membership as being terminated, and any unutilised Rewards earned as at the date and time of the termination of the Membership shall not be refunded, is non-transferable, shall not exchangeable for cash and shall not be restored should the same individual re-sign-up as a Member after termination of the Membership.
- Appeal of membership reactivation can only be done after 1 year of termination by sending an email request to FamilyMart at members-familymart@ql.com.my
- FamilyMart reserves the right to accept or reject such application for membership reactivation at its sole and absolute discretion without assigning any reason.
By being a Member and / or using the Mobile App, you expressly agree that at all times:
- You will only use the Mobile App for lawful purposes;
- You will not use the Mobile App for sending or storing any unlawful material or for fraudulent purposes;
- You will not try to harm the Loyalty Programme and / or the software of the Mobile App in any way whatsoever;
- You will not copy or distribute the software of the Mobile App or any other content without written permission from FamilyMart;
- You will keep secure and confidential your account password (if any) or any identification we provide you which allows access to the Loyalty Programme;
- You will provide FamilyMart with proof of identity as it may reasonably request or require;
- You acknowledge and agree that only one (1) account can be registered on one (1) mobile or electronic device;
- You shall not employ any means to defraud FamilyMart or enrich yourself, through any means, whether fraudulent or otherwise, through any event, promotion or campaign launched by FamilyMart to encourage new subscription or usage of the Loyalty Programme by new or existing customers;
- You shall not impair or circumvent the proper operation of the network which the Loyalty Programme operates on;
- You agree that the Loyalty Programme and Mobile App are provided on a reasonable effort’s basis; and
- You agree that your use of the Loyalty Programme will be subject to FamilyMart’s Privacy Policy (as hereinafter defined) as may be amended from time to time.

POINTS COLLECTION

Points will be awarded to any Transaction made by a Member at any FamilyMart outlet in Malaysia except the following:
- tobacco;
- reloads of mobile phone prepaid, game point, bill payments and other services;
- free gifts and any items redeemed via points / vouchers / coupons;
- any complimentary items obtained during promotional events; and
- take-away plastic bags at the counter.
Every Ringgit Malaysia One (RM 1.00) spent by a Member in a Transaction is equivalent to ONE (1) point (being RM 1.00 = 1 point), exclusive of any tax charged.
Each Transaction receipt shall entitle only one (1) Member to accumulate points.

Members shall be entitled to earn points for each Transaction receipt and based on the integer value per Transaction.

The following is an example of the points collection mechanics:

The Mobile App (with active internet connection / electronic communication) must be presented to the cashier at the point of purchase by a Member for the Transaction at any FamilyMart outlet to ensure that the spending amount is recorded and accumulated. Any failure to do so shall result in the amount spent not being taken into account for points accumulation and FamilyMart shall not be held liable for such failure including where the mobile or electronic device on which the Mobile App is installed on does not have active internet connection or electronic communication for any reason whatsoever.
Points earned from a Transaction may take up to twenty-four (24) hours to be reflected in the Mobile App and redemption of points by a Member shall only be allowed after twenty-four (24) hours has lapsed from the time of the Transaction from which the points were earned.
- In the event points earned from a Transaction are not reflected in the Mobile App after twenty-four (24) hours, the affected Member shall kindly inform FamilyMart via the in-app feedback page within fourteen (14) days from the date of the relevant Transaction by providing all the relevant information and any failure to do so shall result in the Member accepting the points balance as reflected in the Mobile App as correct and final without any further right to claim for unrecorded points and no further correspondence will be entertained.
- FamilyMart reserves the right to correct the points balance provided in your Mobile App if we believe that a billing or accounting error has occurred regardless of whether notice is provided.
Points collected shall be on a cumulative basis subject always to any points collected from a Transaction must be redeemed within two (2) years from the end of the month in which the points were earned ("Expiration Date").
- For example, points collected on 10th November 2018 if not redeemed before 30th November 2020 will expire on 30th November 2020.
- Points not redeemed before Expiration Date shall be forfeited without prior notification, not reinstated and / or refundable.
FamilyMart reserves the right to refuse awarding any points or to remove any points awarded if FamilyMart identifies that the points collected were in error or suspects that the points were fraudulently accumulated or in breach of these Terms & Conditions regardless of whether notice is provided.

POINTS REDEMPTION

Points can be used to redeem Rewards via the Mobile App. A Member may redeem some or all his points for Rewards subject to the Member complying with the procedures for redemption
Rewards redeemed with points may take up to twenty-four (24) hours to be reflected in the Mobile App.
- In the event that Rewards redeemed with points are not reflected in the Mobile App after twenty-four (24) hours, the affected Member shall kindly inform FamilyMart via the in-app feedback page within fourteen (14) days from the date of the relevant Redemption by providing all relevant information. No further correspondence will be entertained for any feedback received after the fourteen (14) days from the time of the Redemption.
Points will be deducted automatically from the Mobile App based on a first in first out basis, upon successful redemption. The points earned at the earliest date will be deducted first, followed by Points earned at later dates, until which the full points required for the redemption is achieved.
All completed redemption shall not be revoked, cancelled, returned or refunded.
FamilyMart, reserves the right to, at its sole and absolute discretion from time to time without prior notification, amend, modify, update, change and / or terminate the Rewards and/or items available for redemption.
FamilyMart reserves the right to refuse any Points Redemption or to remove any Rewards redeemed with points if FamilyMart identifies that the points collected were in error or suspects that the points were fraudulently accumulated or in breach of these Terms & Conditions regardless of whether notice is provided.

REWARDS

Unless expressly provided under these Terms and Conditions, each of the Rewards, in particular Rewards other than points, may respectively be subjected to other terms and conditions as stipulated by FamilyMart.
All Rewards are subject to in-store availability, on a “while stocks last” basis and may be applicable to limited (and not all) FamilyMart outlets or particular products only.
FamilyMart may, at its discretion, replace or substitute any Rewards with any other rewards of similar or equivalent value without prior notice.
Any Rewards earned are non-transferable, non-assignable, not for sale to any third parties and not exchangeable for cash.
Any Rewards earned shall only be redeemed once and at any FamilyMart outlet in Malaysia only. Any unutilised Rewards after the applicable expiration date shall be forfeited, not reinstated and not refundable.
Members shall pay the price difference if the Transaction value is higher than the amount of Rewards used for redemption. However, in the event where the Transaction value is lower than that of the Rewards, the price difference will not be refunded.

PRIVACY POLICY

We at FamilyMart value and understand the importance of your privacy. By signing up for the Membership, you hereby giving your consent to the collection, usage and processing of your personal information as described in our privacy policy at www.familymart.com.my ("Privacy Policy").

SYSTEM HALT OR FAILURE

FamilyMart shall not be liable for any loss or damage in the event of system halt, unavailability or non-performance of the Mobile App as a result of the following:
- Mobile App system is down for maintenance;
- Mobile App fails due to circumstances beyond its reasonable control, including typhoon, earthquake, tsunami, flooding, electrical power failure, war, acts of terrorism and any other force majeure events; and
- Mobile App is interrupted or delayed for reasons such as hacker attacks, technical adjustment or system breakdown on the part of upgrade, technical difficulties, etc to the Mobile App.
FamilyMart reserves the right to terminate the Mobile App at any time due to unforeseen circumstances, applicable laws and regulations and shall not be liable for any loss or damage.

DISCLAIMER

FAMILYMART MAKES NO REPRESENTATION, WARRANTY, OR GUARANTEE AS TO THE SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS, ACCURACY, QUALITY OR COMPLETENESS OF THE LOYALTY PROGRAMME (INCLUDING BUT NOT LIMITED TO THE REWARDS), MEMBERSHIP AND / OR THE MOBILE APP. YOU ACKNOWLEDGE AND AGREE THAT ANY RISK ARISING OUT OF YOUR USE OF THE LOYALTY PROGRAMME (INCLUDING BUT NOT LIMITED TO THE REWARDS), MEMBERSHIP AND / OR THE MOBILE APP AND THIRD PARTY SERVICES (IF ANY), REMAIN AT ALL TIMES SOLELY AND ABSOLUTELY WITH YOU AND YOU SHALL HAVE NO RECOURSE WHATSOEVER TO FAMILYMART.
FAMILYMART DOES NOT REPRESENT OR WARRANT THAT:
- THE LOYALTY PROGRAMME (INCLUDING BUT NOT LIMITED TO THE REWARDS), MEMBERSHIP AND / OR THE MOBILE APP WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS;
- THE USE OF THE LOYALTY PROGRAMME (INCLUDING BUT NOT LIMITED TO THE REWARDS), MEMBERSHIP AND / OR THE MOBILE APP WILL BE SECURE, TIMELY, UNINTERRUPTED OR ERROR-FREE OR OPERATE IN COMBINATION WITH ANY OTHER HARDWARE, SOFTWARE, SYSTEM OR DATA;
- THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, REWARDS OR OTHER MATERIALS PURCHASED OR OBTAINED BY YOU THROUGH THE LOYALTY PROGRAMME AND / OR THE MOBILE APP WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS;
- ANY STORED DATA WILL BE ACCURATE OR RELIABLE;
- ERRORS OR DEFECTS IN THE MOBILE APP WILL BE CORRECTED; AND
- THE MOBILE APP OR THE SERVER(S) THAT MAKE THE MOBILE APP AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS,
THE LOYALTY PROGRAMME (INCLUDING BUT NOT LIMITED TO THE REWARDS), MEMBERSHIP AND / OR THE MOBILE APP ARE PROVIDED TO YOU STRICTLY ON AN “AS IS” BASIS. ALL CONDITIONS, REPRESENTATIONS AND WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT OF THIRD-PARTY RIGHTS, ARE HEREBY EXCLUDED AND DISCLAIMED TO THE HIGHEST AND MAXIMUM EXTENT.

INDEMNITY

By agreeing to the Terms and Conditions upon use of the Mobile App, you agree to assume full responsibility and liability for all loss or damage suffered by yourself, FamilyMart, its franchisor, and each such entities’ parent companies, subsidiaries, affiliates, related companies and their respective directors, employees, agents and representatives or any third party as a result of any breach of these Terms and Conditions and you further agree that you shall defend, indemnify in full and hold FamilyMart, its subsidiaries, affiliates, related companies and their respective directors, employees, agents and representatives harmless from and against any and all losses, damages, rights, claims or cause of action of any kind arising, in whole or in part, directly or indirectly, as a result of or in connection with your:
- use or misuse of the Loyalty Programme and / or the Mobile App;
- violation or breach of any of these Terms and Conditions or any applicable law whether or not referenced herein;
- violation of any rights of any third party;
- use or misuse of the Rewards or your Membership, including any fraud or misrepresentation of the information supplied.

INTERNET DELAYS

The Loyalty Programme and / or the Mobile App may be subject to limitations, delays, and other problems inherent in the use of the internet and electronic communications including the mobile or electronic device used by the Member being faulty, not connected, out of range, switched off or not functioning. FamilyMart shall not be held responsible for any failure of recording any points accumulation, redemption of points or other privileges, and other Mobile App usage related failures, damages or losses resulting from such problems.

LIMITATION OF LIABILITIES

FamilyMart is responsible only for obligations expressly stated in these Terms and Conditions.
No advice or information, whether oral or written, obtained by you from FamilyMart or its staff, or through the Mobile App shall create any warranty on the Loyalty Programme not expressly stated by FamilyMart in these Terms and Conditions.
To the fullest extent permitted by law, FamilyMart shall in no event be liable for any losses, damages, rights, claims or cause of action of any kind incurred, suffered, sustained by you arising from or in connection with your participation or Membership in the Loyalty Programme and use of the Mobile App, including but not limited to:
- any acts, omissions, negligence or wilful default on the part of FamilyMart, its franchisor, and each such entities’ parent companies, subsidiaries, affiliates, related companies and their respective directors, employees, agents and representatives or any third party;
- any loss of data and records relating to the Loyalty Programme or Membership; and
- any loss of value or benefit that may arise as a result of any changes made to the Loyalty Programme.
- any losses or damages (whether direct, consequential, indirect or incidental) to your mobile or electronic device or any applications stored therein as a result of installation or use of the Mobile App.
FamilyMart shall not be liable for any losses, damages, rights, claims or cause of action, including but not limited to any damage or loss to property owned by or in your possession, injury which you may suffer, or any indirect, punitive, special or incidental damages associated or arising from these Terms and Conditions, arising from you participation or Membership in the Loyalty Programme and use of the Mobile App, whether in breach of these Terms and Conditions (including breach of warranty), tort or of whatever causes, even if FamilyMart has been advised of the possibility of such damages. FamilyMart disclaims any responsibility for the aforementioned damages notwithstanding any claim that a sole or exclusive remedy provided in these Terms and Conditions may or does fail of its essential purpose.

INTELLECTUAL PROPERTY RIGHTS

FamilyMart, its franchisor and licensor(s) and related parties, where relevant and applicable shall at all times own all rights, title and interest (whether legal or beneficial), including all related intellectual property rights (including without limitation to trademark, patent, copyright, trade secret) in and to the Loyalty Programme, Website and Mobile App (including in particular the software and its respective components, processes and design in its entirety) and any changes, modifications, improvements and enhancements to any aspect of the Loyalty Programme, Website and Mobile App, whether or not pursuant to any suggestions, ideas, requests, feedback, recommendations or any other information provided by you or any other party relating to the Loyalty Programme, Website and / or Mobile App. These Terms and Conditions do not and does not purport to convey, transfer, assign, novate to you any rights of ownership in or related to the Loyalty Programme, Website and Mobile App or any intellectual property rights owned by FamilyMart.
FamilyMart’s name, logo, the Loyalty Programme, Website and Mobile App (including but not limited to any published content, documents, information, images, graphics, logos, texts and other materials) and any product names associated with the Mobile App are trademarks and the property of FamilyMart, its franchisor and licensor(s), related parties or third parties, and no right or license is granted to you to use the same.
You are allowed to browse through the contents in the Website and Mobile App; however, reproduction is prohibited under the following circumstances (but not limited to):
- All copyrights and other proprietary notices are removed and not visible.
- Information are modified without prior written consent of FamilyMart.
- Information are included in any publications, work, and / or any form of commercial use.
Any such unauthorised reproduction, dissemination, distribution, publication, copying or modification of any of the contents in the Website and Mobile App will lead to a breach of these Terms and Conditions in which legal action may be taken.
The Website and Mobile App may contain content from third parties and FamilyMart does not endorse any applications or sites on the internet that are linked through the Website and Mobile App, and in no event, shall be held responsible and liable for the legitimacy, accuracy, reliability and quality of these content and it is your obligation to take all precautions in all actions and interactions with such third party, conduct independent verification and comply with the third party’s terms of use.

NOTICE

FamilyMart may give notice by means of a general notice on the Website, Mobile App, electronic mail to your email address in records of FamilyMart or by registered mail to your address in the records of FamilyMart. Such notice shall be deemed to have been given:
- immediately upon posting on the Website and Mobile App;
- upon the expiration of forty-eight (48) hours after mailing or posting (if sent by registered mail); or
- upon the expiration of one (1) hour after sending (if sent by email).

LAW AND JURISDICTION

These Terms and Conditions are governed by and are to be construed in accordance with the laws of Malaysia and you hereby agree to submit to the exclusive jurisdiction of the Malaysian Courts for any legal action in relation to these Terms and Conditions.
In the event that any of these Terms and Conditions is or becomes invalid, illegal or unenforceable in any respect, the legality, validity and enforceability of the remaining provisions of this Terms and Conditions shall not be affected or impaired thereby.

NO WAIVER

Any failure or delay of FamilyMart to enforce any right or provision in these Terms and Conditions shall not constitute a waiver of such right or provision unless acknowledged and agreed to by FamilyMart in writing.
